The Smithy still stands, unfortunately it was being converted into something when I last saw it in August 2001 and just looked like a building site and hence I didn't think it worth a picture.

In the name of God Amen I John Daniels (Blacksmith) of the parish of Elmsted in the County of Kent do this 11th day of March in the Year of our Lord One Thousand eight hundred and forty four write this my last Will and Testament in manner and form following I Give and Bequeath to Ann my beloved and lawfull wife all my business stock in trade and property whatsoever it may be after payments of any just debts I nominate constitute and appoint Ann my beloved and faithfull Wife and my Son William Daniels of the Parish of Petham to execute this my last Will and Testament John Daniels ?? Signed Sealed published and declared By the above ?? Testator ?? and for his last Will &Testament who at his request and in his presence and in The presence of each other have subscribed our names as Witnesses thereto Henry Gambrill + Thomas Waters his X mark

 

The before registered Will of John Daniels, deceased, was proved the Seventeenth day of May 1844 before the Reverend John Pechey Francis Clerk Surrogate to the Right Honourable John Nicholl Doctor of Laws Vicar his Grace William Seby?? by devine providence Lord Archbishop of Canterbury primate of all England ?? ??General ^ lawfully constituted by the Oath of John Daniels, Son of the deceased, one of the Executors named In the said Will He being first ?? duly to perform the same (Power reserved of making the like Grant to Ann Daniels Widow the relict of the deceased the other Executor when she shall apply for the same

John Pott Elmsted 1640 PRC 11 7 128

We have no idea of exactly where this small holding was situated, The Pott family has been linked to a number of properties around the area of Bodsham for the following 150 years so we suspect it was somewhere in this area.

The Inventory is on two pages, (the second page is missing on the microfilm), I put links to images of the originals at the start of each page in the hope it may help another researcher decipher writing of the period.

The Admon was in Latin, I have only put the translation on this page

William Pott Chilham 1838 PRC 17 110 273

 

The Smithy in The Street Chilham still stands, but is now converted to a garage.

 

In the Name of God Amen I William Pott of Chilham in the County of Kent Blacksmith being of sound mind memory and understanding Do make and declare this to be my last Will and Testament as follows First I direct my funeral Expences to be paid then I leave to my eldest Son William Pott one shilling To my Daughter Mary Harris I leave one shilling the rest and residue that I posses including my Business Stock in Trade Working Tools and all Household Furniture Watch & Wearing Apparel & whatever belongs to me I Give and Bequeath to my wife Ann Pott for her sole use and Benefit and for the bringing up of my younger children And I leave my wife Ann Pott sole Executor to this my last Will and Testament Witness my Mark + William Pott Signed Sealed and delivered in the presence of us this 25 day of July 1833 Witness by Us Stephen[Finn] George [Terry] July 25 1833

My photocopy of the next page is almost illegible and a full transcription is not yet possible.However the gist of it is as follows:-

Admon was granted to Stephen Finn because Mary Pott died before she claimed the Executorship.

William Pott Waltham 1830 PRC 17 108 218

 

This will probably relates to Little Whiteacre Farm Waltham, the Testator William Pott is implied in the Knights of the Shire Poll for Kent of 1790 [the property of ] Thomas Cullen, [in] Waltham, H[ouse] and L[and],[occupied by] xxxx Pott. The 1839 Tithe assessment states Potts John occupier of 455 Little Whiteacre farm. House, barn, stable + yard-Homestead..

This is the last Will and Testament of me William Pott of the parish of Waltham in the County of Kent Yeoman I give and Bequeath Unto my Son Thomas Pott the Sum of One hundred pounds Sterling And unto my Grand Daughter Mary the Child of my late Daughter Ann Castle the wife of Francis Castle of the City of Canterbury Labourer the sum of Fifty pounds Sterling the said several Legacies to be paid within twelve Calendar Months after my decease And as to all and every my real Estate whatsoever and wheresoever And as to all the Rest Residue and Remainder of my personal Estate and Effects whatsoever and wheresoever (subject [ ] as to my said personal Estate and to the payment of the aforesaid Legacies and to my just Debts and the Charges of proving and executing this my Will I give Devise and Bequeath the same respectively and every part and parcel thereof respectively Unto my Son John Pott his Heirs Executors Administrators and Asigns respectively forever to and for his and their own absolute Use and Benefit And I do hereby appoint my said Son John Pott and William Tucker of the Parish of Waltham aforesaid Victualler Executors of this of this my will In Witness whereof the said William Pott the Testator have to this my last will and Testament set my Hand and Seal this Twenty seventh Day of October in the year of our Lord One thousand eight hundred and twenty nine William Pott + his mark Signed Sealed published and declared by the said William Pott the Testator as and for his last Will and Testament in the presence of us who in his presence at his request And in the presence of each other have hereunto subscribed our hands as Witnesses J [Vincer] [Sol ] Dover Geo.  The following three wills all relate to the Smithy Cake Street Waltham.

In the Name of God Amen I John Pott of the parish of Waltham in the County of Kent Blacksmith being of sound mind and memory God be praised do make and ordain this my last Will and Testament in manner and form following (that is to say) First and principally I [surrendered] my Soul to Almighty God hoping for Salvation thro. the [ ] Death and Sufferings of my Blessed Lord and Saviour Jesus Christ and my Body I commit to the earth to be decently buried at the Discretion of my Executors hereinafter named and as for that Worldly Estate where with it hath pleased Almighty God to bless me I dispose thereof as follows (that is to say) I Give and bequeath all and singular my Household Goods plate Linnen and pictures unto my beloved Wife Jane and my Son John Pott Equally to be divided between them share and share alike Also I give and bequeath unto my Daughter Ann the wife of John Ovenden the sum of five pounds of lawfull money to be paid to her within one year next after my decease by my said son John Pott out of my Shop Goods Stock in trade and residue of my Personal Estate which I have hereinafter bequeathed to him my said Son John Pott and I do hereby also order and direct that all my debts funeral Expenses the charges of proving this my will and all other incedent charges be paid and satisfied out of my said Shop Goods Stock in Trade and residue of my personal Estate and after the payment of the said Legacies and all my debts funeral Expenses the charges of proving this my Will and all other incident charges I give and bequeath all my shop Goods Stock in trade and Residue of my personal Estate (not hereinunder given or disposed of) unto my said son John Pott and do hereby Nominate and Appoint my said Wife and Son John Pott Executors of this my last Will and Testament and do hereby revoke all former Wills and declare this only to be my last Will and Testament. John Pott Waltham 1808 PRC 17 104 134

 

John was the son of the John above and husband of the Mary below.

This was the end of a Pott line, the messuage and smithy was situated on Cake Street Waltham. Both were demolished and the site rebuilt in the later half of the 1900's.

This is the last Will and Testament of me John Pott of the Parish of Waltham in the County of Kent Blacksmith. First I hereby revoke and make void all former and other wills by me heretofore made and Do declare this only to be my last will and Testament. Also I Give and Devise unto my Dearly Beloved Wife Mary Pott All and every my messuages lands tenaments hereditaments and Premises with their appurtenances situate lying and being in Waltham aforesaid or elsewhere in the said County of Kent To hold unto the said Mary my wife and her Assigns for and during the term of her natural life She keeping the same in good and tenantable Repair and from and after her demise I Give and Devise the same and every part and parcel thereof with their and every of their appurtenances Subject to the Payment of the several Legacies hereinafter mentioned unto John Ovenden the younger the Son of my Brother in Law John Ovenden The Elder of Hastingleigh in the said County of Kent Blacksmith unto Samuel Daniels Blacksmith who now lives with me as foreman and To their several heirs and Assigns for ever equally to be divided between them As tenants in common and not as joint tenants. Also I give and Bequeath unto my niece Mary Hartehorn who now lives with me the sum of fifty Pounds of lawful money of Great Britain. Also I give and Bequeath unto William Munday the Son of William Munday late of Stelling Minnis in Said county Yeoman deceased the Sum of Thirty Pounds of like money. Also I Give and Bequeath unto John Tunbridge Bodsom Green in the Parish of Elmsted in the said County of Kent Yeoman and WilliamTunbridge of the Town and Port of New Romney in the said County of Kent Yeoman the Sum of Twenty Pounds apiece of like monies. Also I Give And Bequeath unto Thomas Cocking now or late of Rose and Crown Court Number Ten Moor Fields London the Sum of Five Pounds of like money. Which said several and respective Legacies I will and Direct shall be paid to the several ??? in six Calendar Months next after the decease of my said wife and I hereby charge all and every my said Messuage Lands tenements Investments Premises with their and every of their Appurtenances with the Payment of the several and respective legacies hereinbefore mentioned Also I Give and Bequeath unto the said John Ovenden the younger and the said Samuel Daniels the Sum of Ten Pounds each of like money to be paid unto them respectively in three Calendar Months next after my Decease by my executrix hereinafter named. Also I Give and Bequeath unto the said Samuel Daniels All and every my utensils and Implements in the Trade of a Blacksmith situate and being in the Forge and Shop now in my Possession And Occupation in Waltham aforesaid And all the next residue and Remainder of my Household Goods Chattels and Furniture Stock in Trade Plate Linens and China Ready Moneys and Securities for Moneys and all and every other my Personal Estate whatsoever and Whensoever & after with subject to the Repayment of my just Debts the two last mentioned Legacies Funeral Expenses the Charges of Proving this my Will and all Assigns for ever And Lastly I do hereby make name constitute and Appoint the said Mary my wife sole Executrix of this my last Will and Testament In Witness whereof I the said John Pott the Testator here to this my last Will and Testament contained in two Sheets paper together annexed hereunto set and affixed my Hand and seal to each sheet thereof this seventh Day of December in the Thirty Fourth Year of the Reign of our sovereign Lord George Third by the Grace Of God of Great Britain France & Ireland King Defender of the Faith and so forth and in the year of our lord one thousand seven hundred and ninety three. The before registered will of John Pott deceased was proved the twenty fifth day of April 1808 Before the Reverand Joshua Dix Clerk Surrogate to the Right Honorable Sir William Scott Knight Doctor of laws Official General to the Reverend the Archdeacon of Canterbury lawfully constituted by the Oath of Mary Pott widow the relict and sole exectrix named in the said will She being first sworn will and duly to perform the same.

This is the last will and Testament of me Mary Pott of Waltham in the County of Kent widow I give and bequeath unto Mary Harvey Daughter of my niece Mary the wife of John Harvey the sum of fifty pounds of lawful money of Great Britain to be paid to her when she attains the Age of Twenty five years I give and bequeath unto Thomas the Natural Son of my said Niece commonly called Thomas Matcham the like Sum of Fifty pounds to be paid to him when he attains the said Age of Twenty five Years I Give and Bequeath unto Mary Fagg Daughter of my Niece Lydia the wife of John Fagg the sum of five pounds to be paid to her immediately on my decease I Give and Bequeath all my wearing Apparel of all sorts unto my unto my said two Nieces Mary Harvey and Lydia Fagg equally to be devided between them I will and direct that all my Household Furniture and Personal Estate Plate Linen and China only excepted to be sold and [ deposed ] of by my executors as conveniently may be after my decease and that the Money to arise by such Sale be applied for the benefit of such Persons as the Residue of my Personal Estate is directed to be applied and from and after the Payment of all my just Debts Funeral Expenses the Charges of Proving this my will and all other incedent Charges I Give and bequeath All the rest and residue of my Goods and Chattels Ready money Securities for money and all other my Personal Estate whatsoever and wheresoever Unto all and every Child and Children of the said John Harvey and Mary his wife equally to be divided between them share and share alike as and when they shall respectively attain the Age of Twenty five years And my [mind ] and will is that the said John Harvey and Mary his wife shall [have] and [ ] the use and Benefit of my said Personal Estate until the share and shares of such Child and Children shall respectively become payable to be by them [laid] out to and for the Benefit of such Children respectively and that when and as the said Children shall receptively attain the said Age of twenty five years his her and their share and shares of and in my Personal Estate shall be paid and delivered to them respectively And I do hereby make nominate constitute and appoint the said John Harvey and Mary his wife Executors of this my last will and Testament

In Witness whereof I the said Mary Pott the Testatrix have to this my last will and Testament set my Hand and Seal the Twenty eighth Day of January One thousand Eight hundred and eight. John Potts the Elder of Petham 1842 PRC 17 110 622

John Potts is recorded as being a Butcher in the 1841 census. The 1839 Tithe awards record he owned House, garden and premises and an Orchard in The Street, Petham, also The long Meadow and ten Dwellings in Watery lane Petham. (The ten dwellings were known as Tar Hall due to the fact they were constructed out of tarred timber, they were also liable to flooding every winter when the stream flooded).

 This is the last Will and Testament of me John Potts the Elder of the parish of Petham in the County of Kent Yeoman

First I Give and devise unto my dear wife Charlotte Potts and her Asigns an annuity in yearly rent Charge a sum of twenty six pounds sterling during her life by weekly payments of ten shillings on Saturday in every week clear of all deductions The first of each payments to be made on the first Saturday After my decease And I Give to my said wife the same or the like remedy by distress for the recovery thereof as Landlords have for the recovery of rent in arrears upon Common Leases

And I Give and Devise unto my Son Thomas Potts a like annuity or yearly Rent charge or sum of twenty six pounds Sterling during his life by weekly payments of ten shillings on Saturday in every week clear of all deductions The first of such payments to be made on the first Saturday after my decease And I Give to my said Son Thomas Potts the same or the like remedy by distress for the recovery thereof as Landlords have for the recovery of Rent in arrears upon common Leases

And I hereby subject And charge my Freehold Estates hereinafter devised with the payment of the said several Annuities or yearly rent charges a sums of twenty six pounds and twenty six pounds and the remedies for recovery thereof Provided that if by reason of any Act or default of the said Thomas Potts or by operation of law the said Annuity or yearly rent charge or sum of twenty six pounds hereinbefore given and devised to him or any part thereof shall be aliened charged or disposed of to a in favor of any other person or persons then the same Annuity or yearly rent charge in the sum of twenty six pounds shall thereforth wholly cease

And I Give and Bequeath unto my said Wife Charlotte Potts and her Asigns the use and enjoyment of my Household Goods and Furniture Plate Linen and China during the term of her natural life and after her decease the same to fall into and form part of my residurary personal Estate

And I Give and Bequeath unto my son John Potts the younger the sum of twenty pounds Sterling

And I Give and Bequeath unto my Daughter Mary the Wife of Henry Switton the sum of ten pounds sterling

And unto my Daughter Charlotte the Wife of Robert Fern the like sum of ten Pounds sterling And I direct that the said several legacies shall be vested interests in the several legacies and be paid to them on the decease of my said wife

And I Give and Bequeath the sum of One hundred and fifty pounds Sterling unto all and every the children of my said Son Thomas Potts equally to be devided between them as tenants in common And I direct that the same shall be a vested Interest in such Children immediately on my decease And shall be paid And Payable to them on the decease of the said Thomas Potts but without interest But if my said Wife shall be living at the time of his decease then the Payment thereof shall be postponed until after her death

And I subject and charge my Freehold Estate hereinafter devised with the payment of the said Legacy a sum of One hundred and fifty pounds And (subject to the payment of the said several Annuities or yearly rent charges or sums of twenty six pounds and twenty six pounds and to the remedies for the recovery thereof and to the several Legacies hereinbefore given)

I give Devise and Bequeath All and every my Freehold Messuages or Tenements Lands and Hereditaments and parts and shares of Freehold Messuages or Tenement Lands and Hereditaments and all other my real Estate whatsoever and wheresoever And also all my personal Estate of what material or Kind soever the same may consist and be at the time of my decease unto and to the use of my son George Potts his Heirs Executors Administrators and Asigns respectively for ever according to the nature and quality of the said several Estates And I give And Devise unto my said Son George Potts his Heirs and Asigns All such real Estates if any as are now vested in me as A Trustee A Mortgagee Subject to the Equities affecting the same respectively

And I appoint my said son George Potts sole Executor of this my will And lastly I hereby revoke All my former wills In Witness whereof I the said John Potts the Elder the testador have to the first two sheets of this my last Will and Testament (in three sheets of paper contained) set my Hand and to this third and last sheet Hereof my Hand and Seal the fourth day of January in the year of our Lord One thousand eight hundred and forty two.
