HIPAA law in need of some fine-tuning |

Once again I’m writing to sound off about the “inefficiencies” within our governmental system.
The Health Insurance Portability and Accountability Act of 1996 was designed to protect the privacy of our personal medical information. I have two distinct problems with the act.
First, my husband had a “routine” medical appointment, and I had tried calling him at home later to ask how things went. When I didn’t get an answer I became alarmed. I called the medical center and asked if he had been there. Due to HIPAA, they couldn’t tell me.
Feeling a sense of urgency, I left work and upon arrival at home I found he was in need of immediate medical assistance. He was hospitalized the next day.
Later, he told me that he was hurting so bad he took his pain medications before going for the appointment and by the time he left the medical center they had “kicked in.”
Now, I’m confident the staff at the medical center recognized his “condition” as this had happened once before, except that that time I knew he couldn’t drive so I had driven him to his appointment myself.
But noticing his condition, they could have called me and I could have gone to pick him up, thus avoiding the “accident” that occurred in our driveway – not to mention the potential accident that could have occurred on his way home that may have seriously injured an innocent person.
I’m not blaming the medical center so much, but I do blame HIPAA. And I had medical power of attorney.
Secondly (and our oncologist agrees with this one), where is the privacy when there are several individuals lined up in a room receiving various intravenous therapies?
Some people we met in our “special room” were OK with this, and it was nice to be able to freely discuss our situations. But there were a few who were uneasy about their medical condition being public.
HIPAA has to redefine what is private – to whom and when – particularly where a family member has power of attorney on medical matters, and to provide private rooms when an individual doesn’t want to be public.
I’ve heard others tell where they were discussing their medical issues with clinic personnel on one side of a partition and there were people on the other side well within hearing distance. Where is the privacy? HIPAA certainly needs some changes.
