4 The tenant of a
holiday house undertakes to keep the premises and effects in the same state
of repair and shall pay me the value of any damage or loss to the premises,
fittings and effects other than reasonable wear and tear, and leave the
premises in the same condition of cleanliness and general order in which it
was found.
5 The holidaymaker
promises to reimburse me for any bank charges or losses reasonably sustained
due to cheques being either represented or dishonoured.
6 COMPLAINTS
If you have a complaint, then please
contact the caretaker, who will normally be pleased to correct the discrepancy.
If you receive no satisfaction then contact me. Please remember that
outgoing holidaymakers do not always report damaged equipment and there can
be delay in putting things right at handover.
7 Note that
descriptions are general and not absolute: 'enclosed' garden is a general
statement and not an absolute statement e.g. a dog may be able to 'escape'
from an 'enclosed' garden.
8 The holidaymaker
accepts that where mention is made of local amenities such as pubs, shops,
council swimming pools etc, these types of amenities are a guide only to
what is available in the locality and that these amenities may vary in
detail from those mentioned or be closed or no longer in operation when the
holidaymaker arrives.
9 The contract is
deemed to have been made in Falmouth, Cornwall, and in accordance with
English law.
10 GENERAL and
BASIS OF OCCUPATION
The accommodation is for use as holiday
accommodation only: there is no right to remain in the accommodation after
the holiday. The holidaymaker promises to adhere to arrival/departure times
as notified on directions when sent. The person signing the booking form is
and will remain responsible for members of his/her party and should make
sure they are aware of the booking conditions and that they meet the
obligations arising which arise from them in every way. If the booking
conditions are contravened in any way I may refuse the right of entry to the
property and no money will be refunded.
11 In all cases I
have the right to require a £40 deposit against breakages, cleaning or
damage,
the deposit to be applied against such costs but any balance to be
refunded at the end of holiday or within 7 days.
12 If I have to cancel
due to unforeseen circumstances beyond my control (for example storm or
flood damage to property, death, or other acts of god) liability will be
limited to the following - I will arrange an alternative letting through an
agent of my choice, but if this is unacceptable I will refund the full
amount of the holiday cost.
13 A booking is
only deemed to have been contracted when I have banked the payment and sent
a receipt confirming the booking for the correct house with the correct
dates. Any receipt sent in error (giving incorrect details) is invalid for
these purposes. Any previous action is merely a tentative booking and not
binding on either party.
14 Bookings can
only be made by means of a booking form. ln the case of persons under 18
years of age, the booking form should be signed by a parent or guardian.
15 The
holidaymaker accepts that there may be some imperfections in holiday houses
(as there are in all houses) but also accepts that they may not be central
to the enjoyment of the holiday.
