What?
Sisters of Mercy of Americas, their Regional Community
in Pittsburgh, Pennsylvania (USA) is an employer who was found in violation of the
Fair Labor Standards Act (FLSA) by the US Government.
This Act protects dignity of a fellow man and establishes minimum wage, overtime pay,
record-keeping, and child labor standards.
How?
- by forcing employees to sign the Overtime Payment Waiver Form when they work longer
than 40 hours during a five-day period and in excess of 80 hours during a 14-day
period
- by denying Holiday and Vacation pay to employees who asserted their rights
under FLSA
- by threatening to fire employees who disagree with the management policies
- by firing employees who stood up for their rights
It is against the Law to force employees to waive
their right to Overtime Payment!
It is against the Law to threaten and fire people for protecting their rights!
Some History...
Sisters of Mercy is the
organisation of women founded by Catherine McAuley in 1831. She was a Dublin born
self-possessed person, generous to the end. Her integrity and charity continued to
inspire Sisters of Mercy in their mission. Following her steps, they pledge to serve needy,
poor and suffering. They're also taking care of each other, following Catherine McAuley
instruction she made from her deathbed:
"The sisters are tired; be sure they have a comfortable cup of tea when I am gone."
Who?
Susan Welsh, the Treasurer and Vice President for the Sisters of Mercy
of Americas. She is responsible for the financial policy of the Sisters of Mercy.
While pledging "to serve those in need", Susan Welsh callously disregards Sisters of Mercy
philosophy.
She and her cronies implement policies of underpaying employees, punishing them for speaking
out and getting rid of them all together if they continue to voice their protest against
oppression at the workplace.
Welsh gets much more then a "comfortable cup of tea" by taking money out of her
employees' pockets and leaving them and their children in the cold.
To defend her wrongdoing, Welsh retained one of the most expensive Law Firms
in Pittsburgh, Buchanan Ingersoll. Welsh pays to the one of the city best and highest paid
attorney, Mr. Jerome Richey, to defend unjust cause with the money donated to Sisters of Mercy
to carry on their mission of helping poor, needy and disadvantaged.
Action
The lawsuit had been filed against Sisters of Mercy in July 2001 in the
United States District Court for the Western District of Pennsylvania to
enforce the Fair Labor Standards Act. The Act provides for a minimum wage and overtime compensation and makes it unlawful to discharge or in any other manner discriminate against any employee because such employee has filed a complaint with the Federal Authorities.
