STRESS AND THE LAW

Health & Safety Legislation states that employers have "a duty of care to employees welfare" and requires employers to do everything in their power to prevent injury etc.

Traditionally this referred to physical welfare, but with many successful "stress" court cases over the last few years setting precedents in law, the employers duty of care also now includes psychological / emotional STRESS.

As stated by Prof. Cary Cooper, Government Adviser & Head of Organisational Behaviour at UMIST "Firms are going to have to pay, not just talk about these issues. Never mind lip service about staff being the most valuable resource, the recent court cases were about the duty of care to manage people as human beings".
